BFINIT Web Hosting, Reseller, White Label, and Related Products and Services

This Acceptable Use Policy (the "Agreement") sets forth the terms and conditions of Your use of hosting and related services ("Services"). In this Agreement "You" and "Your" refer to You, as the user of Our Services, or any agent, employee, servant, or person authorized to act on Your behalf. "We", "us", and "our" refer to BFINIT brands and h Panel users, and the group of companies under Bfinit (Bfinit SAS France, Bfinit Ltd England, Bfinit Turkey, Bfinit IT Bangladesh, and its subsidiaries and sister companies).

This Agreement explains Our obligations to You, and explains Your obligations to Us for various services offered by BFINIT brands. By using any services provided by BFINIT, You agree to comply with the terms set forth in this document.

1. Sharing of Information

As a condition of purchasing and using h Panel hosting plans, You acknowledge and agree that Bfinit may provide Your personal information and confidential information about their products and about their partners, if applicable, as necessary to provide You with the selected products and services. This information includes:

  • Information that users provide through optional, voluntary submissions.
  • Aggregated tracking information derived mainly by tallying page views throughout Our sites.

Bfinit does not divulge any information about an individual user to a third party outside of the Bfinit group. However, Your name and information may be disclosed to certain registries within the Bfinit group or regulated authorities under juridical law, if necessary.

2. User Obligations

You represent and warrant that your hosting content does not violate any applicable laws or regulations, and that You own your content or have express written authorization from the owner to use and display the content. The following activities are prohibited:

  • Illegal activity and hosting illegal content.
  • Misuse of system to attempt unauthorized access or transmission of malicious software.
  • Any activities that may cause harm to the operation of a computer or a person’s property.

3. Network Interruptions

Bfinit will use its best efforts to maintain a full-time internet presence for Your account. However, interruptions may occur due to utility failure, equipment malfunction, natural disasters, or human error. Bfinit is not liable for any damages resulting from network interruptions.

To ensure content protection, you must subscribe to geo-location backup services, which may incur an additional fee.

4. Accounts

This Agreement applies to all accounts, sub-accounts, and alternative account names. You are responsible for ensuring compliance with this Agreement by all users under your account.

5. IP Address

Bfinit assigns an IP address for Your use of the Services. The right to use this IP address remains with Bfinit, and You may use it only as allowed by Bfinit.

6. Payment Terms

You may be eligible for a refund under certain conditions. Refund policies are outlined for different services, including hosting and dedicated server plans. Non-payment will result in the suspension or termination of services.

  • 30-day money-back guarantee for first-time h Panel users.
  • 7-day money-back guarantee for dedicated server accounts.

7. Secure Shell (SSH) Access

SSH access may be granted upon request. Any misuse of the system will result in immediate termination of access.

8. Prohibited Activities

You are prohibited from engaging in activities that violate applicable laws or harm Bfinit’s network and reputation. These activities include but are not limited to:

  • Spamming or unsolicited mass email.
  • Hosting content that infringes on intellectual property or promotes illegal activities.
  • Engaging in or promoting any hacking activities.

9. Email and Anti-Spam Policy

You must comply with the CAN-SPAM Act and other relevant regulations on bulk and commercial email. Unauthorized mass email activities may incur a $500 charge to cover the administrative costs related to SPAM.

If we determine you have engaged in SPAM activities, we may share your information with anti-spam organizations and blacklists.

10. Additional Acceptable Use Policy for Virtual Accounts

Server Resource Provision

Your use of the server resources shall not endanger the capacity and operation of the shared server. Below are the acceptable use limits for various accounts:

*The burst allowance is considered an exception to the acceptable use allowance and shall be permitted solely to stabilize the operation of the website during peak intervals. Any user whose account/server employs the higher resources on a consistent basis shall agree to upgrade to a package with higher resource availability.

CPU Burst

You are allowed to use CPU burst for a limited period of time. The CPU burst limitations are as follows:

CPU burst over usage will result in temporary CPU limit restriction for your account, before another CPU burst can be made.

For all account packages, no script may use 25% or more of system resources for 60 seconds or longer. Also, running stand-alone, unattached server-side processes/daemons, web spiders, bit-torrent/P2P applications, cron scripts with intervals of less than 5 minutes, and public file exchange services are strictly prohibited.

11. Additional Acceptable Use Policy for VPS accounts

  • Use of Traffic (Bandwidth): Your account monthly traffic is limited according to the VPS Type. Additional Traffic can be ordered at $10.00 per 100 GB. The fee is non-refundable and applied monthly. If the limit is reached, your account will be suspended until the next month.
  • Disc Space Use: Your account's disc space is limited based on the VPS Type. Up to 4 GB is allocated for system files and cannot be used for storing your content.
  • Additional Services: The initial and renewal fees for each VPS include the number of IPs per VPS type. Additional IPs can be ordered at a fee per month, non-refundable. You can order additional RAM for your VPS, with the fee applied monthly and non-refundable. If payment isn't made on time, the additional RAM or VPS account will be suspended.
  • Additional Limitations: Our services include built-in limitations to prevent invasive activities like DoS attacks and port scans. Triggering these limitations may lead to service interruptions. Bfinit is not liable for damages related to such interruptions.

12. Storage and Security

You are responsible for maintaining your server’s confidentiality and ensuring the security and integrity of your content. Bfinit is not a backup solution and will not be held responsible for any data loss. Services are not intended for data archiving or PCI compliance. Bfinit reserves the right to delete archives if they affect server performance.

13. Transfer of Content

If you terminate your account, it is your responsibility to transfer content off of Bfinit servers. Bfinit will not facilitate the transfer of content or services to another provider.

14. Third-Party Software

Third-party software is provided on an "as-is" basis. Bfinit does not guarantee any specific results. If third-party software is used, it must be compatible with Bfinit servers and approved. Bfinit is not liable for any issues or damages caused by third-party software.

15. Bfinit Reservation of Rights

Bfinit reserves the right to modify pricing, establish limits, and terminate your services if your actions are harmful or illegal. We may also terminate services due to legal threats or for any other reason deemed necessary by Bfinit.

16. Limitation of Liability; Waiver and Release

Services are provided "AS IS" without warranties. Bfinit is not liable for damages from service interruptions, loss of data, or misuse of your account. You assume all risks when using our services.

17. Indemnification

You agree to release and indemnify Bfinit from any liability resulting from your use of our services, including breaches of this agreement or intellectual property infringement.

18. Trademark or Copyright Claims

Bfinit respects intellectual property rights and will take action against violations. If Bfinit receives a copyright infringement claim, we may disclose your information to third parties and may terminate your account for repeated violations.

19. Additional Reservation of Rights

Bfinit reserves the right to deny, cancel, or suspend services for any reason, including legal issues, fraud detection, or violation of terms. Service fees may continue to accrue during investigations.

20. Governing Law and Jurisdiction for Disputes

This agreement will be governed by the laws of France. Any disputes must be brought in France.

21. Notices

Notices will be considered delivered if sent according to the contact information you provide. It is your responsibility to keep this information up to date.

22. Legal Age

You confirm that you are of legal age (18 or over) to enter into this agreement.

23. Final Agreement

This agreement, along with any modifications, constitutes the complete and exclusive agreement between you and Bfinit. It supersedes all prior agreements and may only be modified in writing.

24. No Agency Relationship

This agreement does not create any agency, partnership, or joint venture between the parties.

25. Enforceability

If any provision is deemed unenforceable, the rest of the agreement remains valid. We will modify the provision to fulfill the original intent.

26. Assignment and Resale

Your rights under this agreement are non-transferable. Any attempts to assign or sell your rights will make the agreement voidable at Bfinit’s discretion.

27. Force Majeure

Neither party shall be held liable for failure or delay in performance under this Agreement due to circumstances beyond its reasonable control, including, but not limited to, acts of God, war, terrorism, pandemics, governmental regulations, or technical failures. In such cases, the affected party will promptly notify the other party and make reasonable efforts to resolve the issue as soon as possible.

28. Entire Agreement

This Agreement, including all documents incorporated by reference, constitutes the complete and exclusive agreement between the parties with respect to the subject matter hereof, and supersedes all prior and contemporaneous agreements, proposals, representations, and understandings, whether written or oral, relating to the subject matter. No amendments or modifications shall be binding unless in writing and signed by both parties.
